Baginex.io – Terms and Conditions of Use

Welcome to Baginex.io. These Terms and Conditions (“Terms”) govern your access to and use of Baginex.io (referred to as “we”, “our”, or “the Company”), a digital platform that facilitates the exchange of gift cards and cryptocurrency in Nigeria. By accessing or using our application or website, you agree to be bound by these Terms, including our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use our services.

1. Eligibility

You must be at least 18 years of age.
You must have the legal capacity to enter into binding contracts under Nigerian law.
You must not be a person barred from receiving services under applicable law, including Nigerian and international AML regulations.
We reserve the right to refuse access to any user at our sole discretion.

2. Services Provided

Buying and selling of gift cards (Amazon, Steam, iTunes, Google Play, etc.).
Buying and selling of cryptocurrencies, including Bitcoin, Ethereum, and USDT.
Conversion of digital assets into Naira or other supported currencies.
All transactions are subject to verification and compliance with Nigerian regulatory standards.

3. User Account Registration

Provide accurate, current, and complete information during registration.
Maintain the confidentiality of your login credentials.
Notify us immediately of any unauthorized use of your account.
You are solely responsible for all activities under your account.

4. Know Your Customer (KYC) & AML Compliance

We comply with the Money Laundering (Prohibition) Act 2011 (as amended).
We follow guidelines by the Central Bank of Nigeria (CBN) and Nigerian Financial Intelligence Unit (NFIU).
You may be required to provide ID, BVN, or proof of address before certain transactions are approved.
We may suspend or terminate accounts that fail to meet KYC/AML requirements.

5. Transactions and Exchange Rates

All transactions are final and non-reversible once confirmed.
Exchange rates are determined by Baginex.io and may fluctuate with the market.
We are not responsible for losses due to price volatility or incorrect wallet details provided by users.

6. Prohibited Activities

Fraudulent, illegal, or malicious activity.
Money laundering or terrorist financing.
Transacting stolen or unauthorized gift cards or crypto assets.
Sending/receiving funds from sanctioned persons or countries.
Disrupting or manipulating platform functionality.
Violations may lead to account suspension, termination, and law enforcement reporting.

7. Fees and Charges

Transaction fees or service charges may apply.
All applicable fees will be disclosed before each transaction.
Users agree to pay all fees incurred through use of the platform.

8. Intellectual Property Rights

All logos, graphics, software, and designs belong to Baginex.io.
You may not copy, use, or distribute our intellectual property without prior written consent.

9. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages, including loss of profits or data.
Direct liability is limited to the amount paid for the transaction in question.
We make no warranties regarding accuracy, reliability, or availability of our services.

10. Indemnity

You agree to indemnify Baginex.io, its affiliates, directors, and employees against any claims, losses, or legal expenses arising from:
Breach of these Terms.
Misuse of the platform.
Violation of laws or third-party rights.

11. Termination of Use

We may suspend or terminate access at any time for:
Breach of Terms.
Non-compliance with regulations.
Suspicion of fraudulent or illegal activity.
Upon termination, your access ceases and pending transactions may be canceled.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria.
Disputes will first be resolved through negotiation.
If unresolved, disputes will be settled by arbitration under the Arbitration and Conciliation Act (Cap A18 LFN 2004).
Arbitration will be in English, seated in Lagos, Nigeria.

13. Amendments to Terms

We may update these Terms from time to time.
Changes take effect upon publication or direct user notification.
Continued use of the platform means acceptance of changes.

14. Privacy Policy

By using Baginex.io, you consent to our collection, use, and sharing of your information as described in our Privacy Policy.
